• As a courtesy, product applications, recommendations, and literature are provided by the manufacturers or are based on information provided by the manufacturers. • Exclusion of Warranties. Implied warranties of merchantability and fitness for intended purpose are excluded from the sale of any product.
  
  
• Liability. The Seller’s liability for any claim of any kind (including negligence and strict liability) for any loss or damages arising out of, or resulting from any sale, or from the performance or breach thereof, or from the Products or Services furnished hereunder, shall in no case exceed the price of specified Product or Service which gives rise to the claim.
  
  
• Advice or Assistance. If the Seller, without separate compensation therefore, furnishes Buyer with advice or any other assistance concerning any Product supplied hereunder or any system or equipment in which any such product may be installed, the furnishing of such advice or assistance will not subject the Seller to any liability, whether in contract, warranty, tort (including negligence and strict liability) or otherwise.
  
  
• Buyers Remedies. If the material furnished to the Buyer shall fail, whether as a result of breach of contract, warranty or tort (including negligence and strict liability), or otherwise, to conform to this contract or to any express or implied warranty, the Seller shall replace such non-conforming material at the original point of delivery. Any transportation charges involved in such disposition shall be for the Seller’s account.
  
  
• The Buyers’ exclusive and sole remedy on account of or in any respect of the furnishing of material that shall fail, whether as a result of breach of contract, warranty or tort (including negligence and strict liability), or otherwise, to conform to any sale, or to any express or implied warranty, shall be to secure replacement thereof as aforesaid. The Seller shall not in any event be liable for the cost of any labor expended on any such material or for any special, direct, indirect, incidental or consequential damages to anyone (including property damage and personal injury and death to anyone) by reason of the fact that such material does not conform to this contract or to any express or implied warranty. No other remedies are included or implied.
  
  
• Precedence of Documents. In the event of any conflict between the terms and conditions contained in this document and the terms and conditions contained in any other document utilized by the Buyer, the terms and conditions specified by the Seller shall prevail.
  
  
• WARNING – Use of Products. The product ordered is one which in appropriate applications should provide effective service, however, it may present a fire, health and/or safety hazard if not installed and used properly. If you are not fully acquainted with the application and use of this product, please write, or call the Seller for such information.
  
  
• Severability. Each of the paragraphs of these Terms and Conditions will apply to the full extent permitted by law. The invalidity, in whole or in part, of any paragraph will not affect the remainder of such paragraph or any other paragraph.
